1. Acceptance of Terms

By creating an account, placing an order, using the Mail a Backup service, or otherwise accessing our services, you agree to be bound by these Terms of Service.

If you do not agree to these Terms, do not use the service.

2. Description of Service

Mail a Backup provides software and related services that facilitate the transfer, backup, encryption, storage, and shipment of customer-selected data to physical media.

Mail a Backup does not guarantee that any backup will be successful, complete, recoverable, error-free, timely, secure, or suitable for any particular purpose.

The service is provided on an "as-is" and "as-available" basis.

3. Customer Responsibility

You are solely responsible for:

- Configuring and authorizing access to your systems.
- Providing accurate server, database, cloud storage, and account credentials.
- Verifying the completeness and integrity of backups.
- Testing restoration procedures.
- Maintaining independent backup and disaster recovery solutions.
- Safeguarding encryption keys and account credentials.

Mail a Backup is not responsible for verifying that any backup contains all data necessary for your business or personal needs.

4. Authorization to Access Systems

By using the service, you represent and warrant that you have full authority to grant Mail a Backup access to any server, website, database, cloud storage account, or other system connected to the service.

You agree that all access and activity performed by the service is authorized by you.

5. Assumption of Risk

You acknowledge that granting software access to servers, databases, websites, cloud storage accounts, and other systems involves inherent risks.

You voluntarily assume all risks associated with:

- Installation or use of the service.
- Access to your systems.
- Data transfer operations.
- Backup operations.
- Encryption operations.
- Compression operations.
- File modifications.
- Database exports.
- Restoration attempts.
- Shipping and handling of backup media.

You use the service entirely at your own risk.

6. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAIL A BACKUP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- DATA ACCURACY
- DATA AVAILABILITY
- DATA RECOVERABILITY
- SYSTEM COMPATIBILITY
- UNINTERRUPTED SERVICE

Mail a Backup does not warrant that backups will be successful, complete, recoverable, secure, error-free, or available at any particular time.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAIL A BACKUP, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:

- Loss of data
- Corruption of data
- Loss of profits
- Loss of business
- Loss of revenue
- Business interruption
- Downtime
- Security incidents
- Server failures
- Hardware failures
- Software failures
- Third-party service failures
- Shipping delays
- Lost shipments
- Stolen shipments
- Failed backups
- Incomplete backups
- Unrecoverable backups
- Consequential damages
- Incidental damages
- Indirect damages
- Special damages
- Punitive damages

Whether arising from contract, negligence, strict liability, tort, statute, or any other legal theory.

8. Maximum Liability Cap

To the maximum extent permitted by law, Mail a Backup's total cumulative liability for any claim arising from or related to the service shall not exceed the amount paid by the customer for the specific backup service giving rise to the claim.

9. Shipping and Delivery

Mail a Backup does not guarantee delivery dates, transit times, carrier performance, or shipment security.

Risk associated with shipment, delivery, theft, loss, delay, damage, or destruction of backup media is assumed by the customer.

Delivery confirmation does not guarantee the contents, usability, or recoverability of any backup.

10. Encryption Keys

Customers are solely responsible for maintaining and safeguarding encryption keys, passwords, and credentials.

Mail a Backup is not responsible for:

- Lost encryption keys.
- Forgotten passwords.
- Inaccessible backups.
- Irrecoverable encrypted data.

If a customer loses access to an encryption key, Mail a Backup may be unable to recover the backed-up data.

11. USB Media

The service fee is payment for backup processing, encryption, handling, verification, and shipment services.

The USB drive itself is incidental to the service provided.

No separate warranty is provided for any USB drive, storage device, or physical media included with the service.

USB drives are provided "as-is."

12. No Refunds

All sales are final.

No refunds, credits, chargebacks, or partial reimbursements will be provided for:

- Completed backup attempts.
- Failed backups.
- Incomplete backups.
- Shipping delays.
- Lost shipments.
- Customer configuration errors.
- Customer credential issues.
- Third-party service failures.
- Any other service-related issue.

13. Indemnification

You agree to defend, indemnify, and hold harmless Mail a Backup and its owners, officers, employees, contractors, affiliates, and agents from and against any claims, liabilities, damages, losses, costs, expenses, and attorneys' fees arising from:

- Your use of the service.
- Your systems or data.
- Your violation of these Terms.
- Your violation of any law or third-party rights.
- Any access authorized by you.

14. Termination

Mail a Backup may suspend or terminate access to the service at any time, with or without notice, for any reason or no reason.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between the parties regarding the service and supersede all prior agreements, communications, and understandings.

18. Changes to Terms

Mail a Backup may modify these Terms at any time. Continued use of the service after changes become effective constitutes acceptance of the revised Terms.

19. Pricing, Renewals, and Billing

Mail a Backup reserves the right to change its pricing, fees, shipping charges, service plans, backup schedules, service features, and billing terms at any time and for any reason.

Unless otherwise required by law, existing customers are not entitled to retain introductory, promotional, historical, legacy, or prior pricing. All future backup jobs, recurring services, renewals, subscriptions, and orders may be billed at the pricing in effect at the time the service is performed or charged.

Mail a Backup may modify pricing for existing customers, recurring customers, and subscription customers without creating any obligation to continue providing services at prior rates.

By enrolling in a recurring service, you authorize Mail a Backup to charge your payment method for future backup jobs and recurring services at the then-current rates in effect at the time of billing.

If you do not agree with any pricing change, fee change, service modification, or billing term modification, your sole remedy is to cancel your service before the next billing event or backup job is processed.

Mail a Backup does not guarantee the continued availability of any particular service plan, pricing tier, promotional offer, feature set, or service level.

20. Service Modifications, Account Termination, and Discontinuation

Mail a Backup reserves the right to modify, suspend, restrict, replace, discontinue, refuse, or terminate any aspect of the service, any customer account, or any customer relationship at any time and for any reason, with or without notice, subject to applicable law.

This includes, but is not limited to:

- Backup schedules and frequencies
- Supported website platforms
- Supported operating systems
- Supported hosting environments
- Backup methods
- Encryption methods
- Shipping methods
- Storage media types
- Account features
- Service plans
- Pricing structures
- Eligibility requirements

Mail a Backup does not guarantee that any service, feature, functionality, backup schedule, shipping method, customer account, or offering will remain available for any particular period of time.

The modification, suspension, limitation, refusal, termination, or discontinuation of any service, account, customer relationship, or feature shall not create any liability or obligation on the part of Mail a Backup to continue providing such service, account, customer relationship, or feature.

21. Backup Scheduling and Timing

Backup schedules, estimated backup dates, recurring intervals, calendar displays, and projected processing times are provided for convenience only and are not guaranteed.

Although customers may select a recurring frequency (such as daily, weekly, monthly, or another interval) or be shown an anticipated backup date, the actual creation, processing, shipment, or completion of any backup may occur earlier or later than the scheduled or estimated date. Delays or variations of several days or more may occur due to system load, maintenance, shipping logistics, technical issues, customer system availability, operational considerations, or other factors.

Mail a Backup does not guarantee that any backup will be initiated, processed, completed, or shipped on a specific date or at a specific time, and any displayed schedule should be considered an estimate only. Such timing variations do not constitute a breach of these Terms and do not entitle the customer to any refund, credit, or other compensation.
